PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.
Refunds/Returns
Items may be returned within seven days of receipt, and must be in the SAME CONDITION as when we mailed it out to you.
Contact us prior to shipping the item back, so we can expect the item to arrive.
All items must be shipped prepaid, with insurance. Any damages or loss on the return of your item are your responsibility. We will refund you the cost of the item but NOT the cost of the shipping you paid. Once
we receive the return we will process the refund (in the same fashion
you paid) or if you'd like, we can credit your account towards a future
purchase.
If you are returning an item due to a mistake we've made (ie: wrong item, wrong size, etc...) please let us know.
QUALITY ISSUES / RETURNS
If your item is not holding up due to a quality issue within 30 DAYS of receipt please email us and explain how the item is defective.
A store credit will be applied to your account. Because of the cost of
shipping, it is often not worth the cost to mail the item back -
especially if the item is deffective, as it no longer serves a purpose
for us to re-stock the item. THIS EXCLUDES JEWELLERY ITEMS. (see below)
JEWELLERY RETURNS / DAMAGES
Jewelry returns may only be made if the jewellery you received was the wrong item, wrong size, or wrong stone, or the item is not what you had in mind.
If the mistake was ours and you'd like to return the piece, please let
us know prior to return. You will not have to pay return shipping for a
mistake we've made.
If you are returning the jewellery because it's not what you had in
mind - please return within 7 days of receipt. Jewellery must be in same
condition as sold for a refund/credit. Once we receive the return
you will be refunded or credited (your choice) for the cost of the jewellery, but not the return shipping.
If the jewellery arrives to you visibly damaged
due to shipping it is your responsibility to report this to us upon
receipt. We can file a postal claim for the damages during shipping.
There is a small window of opportunity to file this claim, so don't
delay in letting us know if there is a problem!
WEAR DAMAGE: We do not guarantee jewellery against wear. If jewellery was damaged while you were wearing the piece we cannot refund, credit or exchange the jewellery.

Limitation of Liability

Typographical Errors
In the event that a Cat and Cauldron product is mistakenly listed at an incorrect price, Cat and Cauldron reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Cat and Cauldron reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Cat and Cauldron shall issue a credit to your credit card account in the amount of the incorrect price.
Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Cat and Cauldron without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Cat and Cauldron may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Cat and Cauldron.
Miscellaneous
Your use of this site shall be governed in all respects by the laws of the state of California, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Cat and Cauldron products) shall be in the state or federal courts located in Los Angeles County, California. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Cat and Cauldron products) must be commenced within one (1) year after the claim or cause of action arises. Cat and Cauldron's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Cat and Cauldron may assign its rights and duties under this Agreement to any party at any time without notice to you.
Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Cat and Cauldron or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law.
